CopyKitten Discord Bot – Terms of Service

Welcome to CopyKitten! These Terms of Service (“Terms”) govern your access to and use of the CopyKitten Discord bot (“CopyKitten,” “the Bot,” “we,” “us,” or “our”). By adding CopyKitten to your Discord server, interacting with it, or using any of its features, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use CopyKitten.

Please read these Terms carefully, especially the sections regarding Voice Cloning, User Conduct, and Disclaimers.

1. Acceptance of Terms

1.1. By using CopyKitten, you affirm that you are at least 13 years of age, as per Discord’s Terms of Service. If you are under 13, you are not permitted to use CopyKitten.
1.2. Your use of CopyKitten constitutes your explicit agreement to these Terms. If you do not agree, do not use the Bot.
1.3. These Terms may be updated periodically. It is your responsibility to review them regularly. Continued use of CopyKitten after any changes signifies your acceptance of the revised Terms.

2. Key Definitions

  • User: Any individual interacting with the CopyKitten bot on Discord.
  • Voice Donor: An individual whose voice is recorded, processed, and used to create a Voice Clone.
  • Voice Clone: The synthetic voice model generated by CopyKitten, replicating a Voice Donor’s voice.
  • Generated Speech: Any audio output created by a User using a Voice Clone and text-to-speech functionality.

3. CopyKitten Service Description

CopyKitten allows Users to:

  • Create Voice Clones of consenting Voice Donors.
  • Use these Voice Clones to generate speech from text (text-to-speech).

4. Voice Cloning & Consent – CRITICAL INFORMATION

4.1. Strict Consent Requirement: CopyKitten operates on an absolute and non-negotiable consent-based system for voice cloning. You are expressly prohibited from creating a Voice Clone of any individual without their explicit, verifiable, and informed consent.
* CopyKitten provides specific in-bot mechanisms for Voice Donors to grant and revoke consent. Users attempting to clone a voice must ensure these mechanisms are properly utilized to obtain consent.
4.2. Misrepresentation of Consent: Any attempt to circumvent, bypass, or fraudulently obtain consent for voice cloning is a serious violation of these Terms and may result in immediate and permanent termination of your access to CopyKitten, and potential reporting to Discord.
4.3. Voice Clone Ownership & Deletion:
* The Voice Donor retains full rights to their voice.
* CopyKitten provides a clear and accessible method for a Voice Donor to permanently delete their Voice Clone at any time. Once a Voice Clone is deleted via this method, it is removed from our systems and cannot be recovered.
* Users are responsible for understanding and respecting the Voice Donor’s right to delete their Voice Clone.

5. User Conduct & Responsibilities

5.1. Lawful Use: You agree to use CopyKitten only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit anyone else’s use and enjoyment of CopyKitten.
5.2. Responsibility for Generated Speech: You are solely and entirely responsible for the content of any Generated Speech created using CopyKitten. This includes, but is not limited to, the text input, the context of its use, and its distribution.
5.3. Prohibited Conduct: You agree NOT to use CopyKitten to:
* Generate, distribute, or promote malicious, harmful, hateful, discriminatory, defamatory, abusive, harassing, threatening, or obscene content.
* Engage in any form of cyberbullying, harassment, or intimidation.
* Impersonate others in a manner that is deceptive, harmful, or without explicit consent from the person being impersonated and the Voice Donor (if different).
* Misrepresent facts, create false information, or spread misinformation.
* Infringe upon any intellectual property rights, privacy rights, or other rights of any third party.
* Engage in any illegal activities.
* Exploit, abuse, or circumvent any features of CopyKitten, including the consent mechanisms.
* Distribute spam, unsolicited messages, or advertising.
* Interfere with or disrupt the operation of CopyKitten or its associated servers.
* Attempt to gain unauthorized access to any part of CopyKitten’s systems.
5.4. Reporting Misuse: If you encounter or become aware of any misuse of CopyKitten, particularly concerning the unauthorized use of voices or prohibited content, please report it to us immediately using the contact information provided below.

6. Data and Privacy

6.1. CopyKitten collects and processes voice data solely for the purpose of creating and enabling the use of Voice Clones as described in these Terms.
6.2. We do not store raw voice recordings after the Voice Clone has been generated, unless necessary for troubleshooting or explicit user request for the purpose of Voice Clone creation or improvement (and always with consent).
6.3. User IDs and server IDs are collected for the functionality of the bot (e.g., to link Voice Clones to users, manage permissions).
6.4. CopyKitten does not share Voice Clones or associated data with third parties, except as required by law.

7. Disclaimers

7.1. NO RESPONSIBILITY FOR GENERATED SPEECH: COPYKITTEN IS A TOOL. WE ARE NOT RESPONSIBLE FOR THE CONTENT, ACCURACY, OR LEGALITY OF ANY SPEECH GENERATED BY USERS. USERS ARE SOLELY RESPONSIBLE FOR THEIR ACTIONS AND ANY CONSEQUENCES ARISING FROM THEIR USE OF COPYKITTEN.
7.2. “AS IS” BASIS: CopyKitten is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that CopyKitten will be uninterrupted, error-free, or free of harmful components.
7.3. Voice Clone Quality: While we strive for high-quality voice cloning, the fidelity and accuracy of a Voice Clone can vary based on the quality of the input audio and other factors. We do not guarantee perfect replication.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall CopyKitten, its creators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use CopyKitten; (ii) any conduct or content of any third party on CopyKitten; (iii) any content obtained from CopyKitten; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Indemnification

You agree to defend, indemnify, and hold harmless CopyKitten, its creators, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney’s fees and costs, arising out of or in any way connected with your access to or use of CopyKitten, your violation of these Terms, or your infringement of any third-party rights, including without limitation, copyright, property, or privacy rights.

10. Termination

We reserve the right to suspend or terminate your access to CopyKitten immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use CopyKitten will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State, e.g., “the State of California, USA”], without regard to its conflict of law provisions.

12. Miscellaneous

12.1. Entire Agreement: These Terms constitute the entire agreement between you and CopyKitten regarding the use of the Bot.
12.2. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
12.3. Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and CopyKitten’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
